1. Eligibility and permitted use

You may use the site only for lawful purposes. By placing an order, you represent that you are legally capable of entering into the transaction and that the information you provide is accurate and complete.

You may not interfere with the site's operation or security, attempt unauthorized access, scrape or harvest data in a manner that violates law or our rights, introduce malicious code, impersonate another person, or use the site to commit fraud or other unlawful conduct.

2. Products and availability

SPLASH Decor offers decorative surface products that may include wallpaper, wallcoverings, decorative tile, samples, and related products. Product availability may change without notice. We may limit quantities, discontinue products, correct errors, or refuse an order where reasonably necessary, including for suspected fraud, pricing errors, supply limitations, legal restrictions, or misuse of the site.

Submitting an order does not guarantee acceptance. An order is accepted when we confirm it or begin fulfillment, subject to payment authorization and applicable law.

3. Product images, color, scale, and pattern

We work to present product imagery and specifications accurately, but screens, lighting, browsers, devices, print media, finishes, glazes, substrates, and production conditions can affect perceived color, gloss, texture, scale, and contrast. Natural-surface-inspired designs may intentionally contain visual variation.

Where color, texture, finish, or scale is critical, order and review an available sample before committing to a full installation. Normal production variation within the product description is not a guarantee of identical appearance across screens, samples, rolls, boxes, or production lots.

4. Measurements, coverage, and quantity estimates

Dimensions and coverage figures described as nominal, approximate, calculated, or estimated are planning tools. Site calculators and coverage estimates do not replace field measurements or professional installation planning. You are responsible for confirming wall dimensions, openings, pattern layout, waste, cuts, repeats, substrate conditions, and sufficient overage before ordering.

For projects requiring multiple rolls or boxes, we recommend ordering the full anticipated quantity at one time to reduce the possibility of variation between production lots.

5. Pricing, taxes, and payment

Prices are shown in the currency displayed at checkout and may change before an order is placed. Applicable shipping, taxes, and other charges are displayed or calculated during checkout where possible. If a material pricing or product-description error affects an order, we may contact you to confirm a correction or cancel and refund the affected order as permitted by law.

Payments may be processed by third-party payment providers such as Stripe. Your use of a payment method is also subject to the provider's terms. You authorize us and our payment providers to charge the total amount shown at checkout and to process refunds or adjustments consistent with these Terms and our policies.

6. Shipping and delivery

Shipping and delivery estimates are estimates unless we expressly promise a specific shipment or delivery date. We will comply with applicable law governing shipment promises, delays, cancellation options, and refunds. Delivery may be affected by carrier operations, weather, address issues, customs, force majeure events, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and for inspecting shipments promptly after delivery. Risk-of-loss and title rules will be applied consistently with applicable law and the carrier/shipping terms used for the order.

7. Inspection and installation

Inspect all material before installation. Confirm product identity, quantity, dimensions, visible condition, color/finish, pattern orientation, and suitability before cutting, trimming, applying adhesive, installing, grouting, drilling, sealing, or otherwise altering the product.

Installation conditions vary. You are responsible for ensuring that the substrate, moisture level, surface preparation, adhesive, grout, sealer, tools, environmental conditions, and installation method are suitable for the product and application. Use a qualified professional installer when appropriate and follow manufacturer/product instructions.

To the extent permitted by law, SPLASH Decor is not responsible for labor, demolition, reinstallation, substrate repair, project-delay, or consequential costs caused by installation of material that had a visible issue reasonably discoverable before installation.

8. Returns, refunds, and cancellations

Our Return Policy and Refund Policy are incorporated into these Terms. Eligible standard products have a 30-day return window after delivery, subject to the conditions and exclusions stated in those policies.

9. Custom and customer-specific products

Products expressly identified before purchase as custom, bespoke, personalized, custom-sized, or made to customer-specific specifications may have different cancellation and return rights because production is undertaken specifically for that order. Any such restriction will be disclosed before purchase and remains subject to applicable law.

10. Intellectual property

The site and its content—including SPLASH Decor branding, surface designs, artwork, photographs, product imagery, print layouts, text, graphics, software, page design, and other original material—are owned by or licensed to SPLASH Decor and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the site for personal or internal business shopping purposes. No purchase transfers ownership of our underlying artwork, design files, print masters, trademarks, or other intellectual property.

You may not reproduce, distribute, sell, license, scrape for commercial reproduction, create counterfeit products from, or otherwise exploit protected SPLASH Decor content except with our written permission or as allowed by law.

11. Reviews, submissions, and feedback

If you voluntarily send us product feedback, suggestions, or non-confidential ideas, you grant us permission to use that feedback to improve our products and business without an obligation to compensate you. You retain ownership of original content you submit, subject to any specific permission you give us to display or use it.

12. Third-party services and links

The site may use or link to third-party services, including payment, shipping, communication, and other providers. We do not control third-party websites or their independent terms, privacy practices, availability, or content.

13. Disclaimer of warranties

Except for express warranties we specifically provide in writing and warranties that cannot lawfully be excluded, the site and products are provided on an “as available” and “as is” basis. To the maximum extent permitted by law, we disclaim implied warranties that may otherwise apply, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits a warranty, guarantee, right, or remedy that cannot legally be excluded or limited.

14. Limitation of liability

To the maximum extent permitted by law, SPLASH Decor will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the site or products, including lost profits or project delays, where such damages may lawfully be excluded.

For claims that may lawfully be limited, our aggregate liability relating to a product order will not exceed the amount you paid us for the specific product giving rise to the claim. These limitations do not apply where prohibited by law, including liability that cannot be waived or limited under applicable consumer-protection law.

15. Indemnification for misuse

To the extent permitted by law, you agree to be responsible for third-party claims, losses, or reasonable costs arising from your unlawful use of the site, infringement of another person's rights through content you submit, or material violation of these Terms. This section does not require a consumer to indemnify SPLASH Decor for our own unlawful conduct, negligence where such indemnification is prohibited, or a matter that cannot lawfully be shifted to the consumer.

16. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles, except to the extent another jurisdiction's mandatory consumer-protection law applies and cannot be waived.

Unless applicable law requires otherwise, disputes arising from these Terms or a purchase may be brought in a state or federal court with jurisdiction in New Jersey, with venue in or serving Passaic County. Nothing in this section prevents either party from using an eligible small-claims court or exercising a non-waivable statutory right.

17. Changes to these Terms

We may update these Terms from time to time. Changes apply prospectively from the effective date posted on this page unless applicable law requires otherwise. The Terms in effect when you placed an order will continue to govern that transaction to the extent required by law.

18. Severability and no waiver

If a provision of these Terms is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
